1. TERMS AND CONDITIONS 

1.1 - The following terms and conditions apply to all purchases by you of products from our website ("Products") from ("W H Watts & Son Ltd") and you should read them carefully. We may vary these terms from time to time and therefore you should check them before you make a new purchase.

1.2 - We have done everything to ensure that the descriptions of the items on the website are as accurate as possible; however we cannot be held responsible for any real or perceived discrepancies of products from their descriptions. Descriptions are constantly checked and verified with our suppliers for accuracy.

2. APPLICATION OF TERMS 

2.1 - Subject to any variation under condition 2.2 this agreement shall be on these conditions to the exclusion of all other terms and conditions (including any terms or conditions which you purport to apply under any confirmation of order or other document) and shall apply to all purchases of Products from W H Watts & Son Ltd.

2.2 - When you place an order to purchase a product from whwatts.co.uk we will send you an e-mail confirming receipt of your order and containing details of your order. Your order represents an offer to W H Watts & Son Ltd to purchase a Product which is accepted by us when we send an e-mail confirming receipt of your order. Any Products on the same order which have not been confirmed in an e-mail confirming receipt do not form part of that contract.

2.3 - The purchase area of our website is secure and we use industry standard SSL encryption for the processing of all sensitive information.

3. DELIVERY 

3.1 - Subject to stock availability, we will endeavour to despatch all Products within 7 days of the date of confirmation of order by us or within a reasonable time. Delivery is included in the price offered. Please note that we are unable to send Products outside of mainland UK or to BFPO addresses.

3.2 - Orders on items in stock placed before 12pm will be dispatched the same working day on 24hr courier.  This means that you should receive your order the next working day between 8am and 6pm.  Orders on items not in stock will take, approximately, the time indicated on that items web page. Please note we do not despatch nor deliver goods on Saturdays, Sundays or Public holidays.

3.3 - Any dates specified by W H Watts & Son Ltd for delivery of the Products are intended to be an estimate. If no dates are so specified, delivery shall be within a reasonable time.

3.4 - Furniture only - Free delivery and assembly applies only to a minimum order of 2 pieces of large furniture (this excludes - shelves, chest extenders, toy boxes, additional drawers, cot-top changers, additional wardrobe storage tops) unless the order totals over £400. (For example - a Cot-bed + Shelf totalling under £400 (and over £100) would qualify for free delivery, but would not qualify for free assembly). Orders totalling under £100 will be sent by carrier and are subject to a carriage charge.

3.5 - Delivery times quoted are approximate and are subject to manufacturer’s availability.

3.6 - Delivery times quoted are subject to arrangement of a convenient delivery and assembly time. This can be arranged via phone or email once your order arrives in stock.

3.7 - Prior to delivery & assembly, the room in which the furniture is intended to occupy should be cleared and a space large enough to assemble the furniture should be made available. The room should preferably be large enough for 2 persons to work in, along with the furniture (minimum 6' x 8' [1.83m x 2.44m]) - if this is not possible then an additional space - preferably an adjacent, adjoining or reasonably close area should be provided if possible as some pieces of furniture cannot/should not be moved due to size, weight and construction.

5. PRICE

5.1 - Unless otherwise agreed by W H Watts & Son Ltd in writing, the price for the Products shall be the price set out on W H Watts & Son Ltd´s website on the day of purchase.

5.2 - The price for the Products shall be inclusive of any value added tax and inclusive of delivery charges where Products are to be delivered to you.

6. PAYMENT 

6.1 - Payment of the price for the Products must be made by you by credit or debit card at the time of order. Your card will be debited on or before despatch of the Products to you.

7. QUALITY 

7.1 - Where W H Watts & Son Ltd is not the manufacturer of the Products, W H Watts & Son Ltd shall endeavour to transfer to you the benefit of any warranty or guarantee given to W H Watts & Son Ltd ("the Warranty").

7.2 - W H Watts & Son Ltd warrants that (subject to the other provisions of these conditions) upon delivery the Products shall:
(a) be of satisfactory quality within the meaning of the Sale of Goods Act 1979 (as amended);
(b) be reasonably fit for the purpose for which they are intended to be used.

7.3 - W H Watts & Son Ltd shall not be liable for a breach of the Warranty in condition 8.1 unless you give written notice of the defect to W H Watts & Son Ltd as soon as possible when you discover or ought to have discovered the defect and in any event within the period of the Warranty.

7.4 - W H Watts & Son Ltd shall not be liable for a breach of the Warranty if:

• you make any further use of such Products after giving such notice; or
  
• the defect arises because you failed to follow W H Watts & Son Ltd‘s oral or written instructions or the instructions set out in the manufacturer's product manual as to the construction, storage, use or maintenance of the Products; or
  
• you alter or repair such Products without the written consent of W H Watts & Son Ltd.

7.5 - Subject to condition 7.3 and condition 7.4, if any of the Products do not conform with the Warranty W H Watts & Son Ltd and/or the manufacturer of the Products shall at its option repair or replace such Products (or the defective part) or refund the price paid for such Products against production by you of a valid receipt provided that you return the Products or the part of such Products which is defective to W H Watts & Son Ltd. Any other refunds or exchanges in respect of unused Products with their original packaging where there is no breach of the Warranty or any of the warranties shall be at W H Watts & Son Ltd’s discretion and in any event a refund or exchange will not be considered by W H Watts & Son Ltd more than 30 days of the date of purchase or delivery.

Without prejudice, no refund or exchange will be given for: (a) nappys', toiletries, bottles or other personal items; (b) self-assembly furniture once partially or fully assembled; (c) curtains and bedding once removed from packaging;

This does not affect your statutory rights

8. RETURNS 

8.1 - Damaged or missing parts?

For all deliveries signed as 'unchecked' any damage and/or missing parts must be reported to us in writing or by e-mail within a resonable period of time.

If a box looks damaged in any way, shape or form it should be signed for as ‘box damaged’ and any damage/missing parts must be reported to us in writing or by e-mail within 7 working days.

If a delivery is signed as ‘checked’ any damage/missing parts must be reported to us via e-mail / phone call within 24hrs otherwise any claim will be void for the item and will then become chargeable repair / replacement.

8.2 - Faulty Goods?

Please Note: All goods collected by our courier will incur a minimum return carriage charge of £16.00 per box. Our standard £16.00 per box charge includes carriage back to the consumer. Contact us before returning goods as many problems can be solved prior to items being returned. If the goods need to be returned then a repair, refund or replacement will be offered depending on each individual case. Please contact us before sending items back.

If you are returning goods deemed to be faulty the £16.00 per box charge will still stand when using a courier and will only be refunded when the goods are confirmed as faulty by our Service Department. Please remember to enclose your name, address, telephone number, email address and reason for returning the goods. 

Customers are still liable for the postage costs (i.e. Royal Mail) of items to be returned if they are deemed too small to require a courier.

9. FORCE MAJEURE

9.1 - W H Watts & Son Ltd shall not be liable to you for any breach of this agreement, for delay or failure to perform if the delay or failure is due to acts of God, civil commotion, riots, explosion, floods, drought, fire, lock-outs, strikes or other labour disputes or other causes beyond our reasonable control. This does not affect your statutory rights.

10. DATA PROTECTION 

10.1 - W H Watts & Son Ltd will treat all of your personal information in accordance with all applicable UK data protection laws.

10.2 - Your information will enable us to provide you with access to all parts of our site and to supply the goods or services you have requested. It will also enable us to bill you and to contact you where necessary concerning your orders. We will also use and analyse the information we collect so that we can administer, support, improve and develop our business.

11. CONSUMER PROTECTION (DISTANCE SELLING) REGULATIONS 2000 

11.1 - You have the right to cancel any order, but this right ends eight working days after the date of delivery of the Products. W H Watts & Son Ltd will credit you for any cancelled items within 30 days of your cancellation. If W H Watts & Son Ltd has delivered the Products by the date of cancellation you must return the Products to W H Watts & Son Ltd within 14 working days of delivery and pay the costs of doing so. If you fail to return the Products in the specified time, W H Watts & Son Ltd reserve the right to recover the Products from you and you will to pay the costs of W H Watts & Son Ltd doing so.

11.2 - Other than a cancellation in accordance with condition 10.1, no order for Products may be cancelled by you without the prior written consent of W H Watts & Son Ltd. If W H Watts & Son Ltd agrees to accept a cancellation it shall be entitled to charge you a minimum cancellation fee of twenty per cent of the price to cover the costs and expenses incurred by W H Watts & Son Ltd as a result of the cancellation.

W.H.Watts & Son Ltd. disclaims damages of any kind, compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties implied or otherwise relating to use of this site.
