Terms & Conditions


1.0 TERMS AND CONDITIONS 

1.1 The following terms and conditions apply to all purchases by you of products from our website ("Products") from ("W H Watts & Son Ltd") and you should read them carefully. We may vary these terms from time to time and therefore you should check them before you make a new purchase.

1.2 W H Watts & Son Ltd. does not accept liability (except as set out below) for any errors and omissions and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services.

1.3 If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. We shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price, if the item(s) has been charged and not dispatched we will cancel and refund your order.

 

2.0 APPLICATION OF TERMS 

2.1 Subject to any variation under condition  this agreement shall be on these conditions to the exclusion of all other terms and conditions (including any terms or conditions which you purport to apply under any confirmation of order or other document) and shall apply to all purchases of Products from W H Watts & Son Ltd.

2.2 When you place an order to purchase a product from whwatts.co.uk we will send you an e-mail confirming receipt of your order and containing details of your order. Your order represents an offer to W H Watts & Son Ltd to purchase a Product which is accepted by us when we send an e-mail confirming receipt of your order. Any Products on the same order which have not been confirmed in an e-mail confirming receipt do not form part of that contract.

2.3 The purchase area of our website is secure and we use industry standard SSL encryption for the processing of all sensitive information.

 

3.0 DELIVERY 

3.1 - Subject to stock availability, we will endeavour to dispatch all Products within 7 days of the date of confirmation of order by us or within a reasonable time. Delivery costs are shown where applicable. Please note that we are unable to send some Products outside of mainland UK or to BFPO addresses. International sales will incur shipping charges and on some items possibly a customs charge as well so please contact us for details / costs. Shipping to Scottish Highlands & Islands are not eligible for free delivery and will also incur shipping charges. Please contact the store for pricing. We reserve the right, under some circumstances, to insist on delivery being made to the billing address supplied at the time of ordering.

3.2 Orders on large items in stock placed before 11pm will be dispatched the same working day on 48hr courier.  This means that you should receive your order within 48hrs between 8am and 6pm. Smaller items and items under £50 will be dispatched through alternative couriers and may take several working days. Orders on items not in stock will take, approximately, the time indicated on that items web page. Please note we do not dispatch nor deliver goods on Saturdays, Sundays or Public holidays. We do not take any liability for any delays caused due to Courier related issues.

3.3 Any dates specified by W H Watts & Son Ltd for delivery of the Products are intended to be an estimate. If no dates are so specified, delivery shall be within a reasonable time.

3.4 Furniture only 
Free delivery by W H Watts (within 60 mile radius of the store only) applies only to a minimum order of 2 pieces of large furniture (this excludes - shelves, chest extenders, toy boxes, additional drawers, cot-top changers, additional wardrobe storage tops) smaller items over £50 will qualify for free delivery. Orders totalling under £50 will be sent by carrier and are subject to a carriage charge. Some furniture deliveries in the UK may incur a delivery charge due to their size, weight and volume of boxes so please contact us for details before ordering.

3.5 Delivery times quoted are approximate and are subject to manufacturer’s availability.

3.6 Some manufacturers may offer delivery and assembly. Delivery times quoted are subject to arrangement of a convenient delivery and assembly time. This can be arranged via phone or email once your order arrives in stock.

3.7 Prior to delivery, access to the room where the furniture is to be delivered should be cleared of obstacles and wall hangings should be removed (especially on stairways). The room in which the furniture is intended to occupy should be cleared and a space large enough to assemble the furniture should be made available. The room should preferably be large enough for 2 persons to work in, along with the furniture (minimum 6' x 9' [1.83m x 2.74m]) - if this is not possible then an additional space - preferably an adjacent, adjoining or reasonably close area should be provided if possible as some pieces of furniture cannot/should not be moved due to size, weight and construction. PLEASE NOTE: WE DO NOT REMOVE THE EMPTY BOXES AFTER INSTALLING THE FURNITURE. 

3.8 Free delivery and assembly can be revoked at any time without prior notification and at the manager's / manufacturers discretion.

3.9 Any deliveries made outside of Europe can be subject to customs Tax & Duty charges payable by the recipient.

 

4.0 NON-DELIVERY 

4.1 If your item is not delivered please contact us via telephone or e-mail. If you arranged collection using your own courier please contact them directly as W H Watts & Son Ltd. will accept no liability once the goods have left the store.

 

5.0 PRICE

5.1 Unless otherwise agreed by W H Watts & Son Ltd in writing, the price for the Products shall be the price set out on W H Watts & Son Ltd. website on the day of purchase, with the exception of the conditions outlined in section 1.3.

5.2 The price for the Products shall be inclusive of any value added tax and inclusive of delivery charges where Products are to be delivered to you.

 

6.0 PAYMENT 

6.1 Payment for the Products will be taken in full at the time of order. Payment can be made using credit card,debit card, Paypal or Goggle Checkout. Card details must match with the billing address and any mismatches or missing details will result in the order being cancelled and a refund issued.

 

7.0 QUALITY 

7.1 Where W H Watts & Son Ltd is not the manufacturer of the Products, W H Watts & Son Ltd shall endeavour to transfer to you the benefit of any warranty or guarantee given to W H Watts & Son Ltd ("the Warranty").

7.2 W H Watts & Son Ltd warrants that (subject to the other provisions of these conditions) upon delivery the Products shall: 

(a) be of satisfactory quality within the meaning of the Sale of Goods Act 1979 (as amended); 

(b) be reasonably fit for the purpose for which they are intended to be used.

7.3 W H Watts & Son Ltd shall not be liable for a breach of the Warranty in condition  unless you give written notice of the defect to W H Watts & Son Ltd as soon as possible when you discover or ought to have discovered the defect and in any event within the period of the Warranty.

7.4 W H Watts & Son Ltd shall not be liable for a breach of the Warranty if you make any further use of such Products after giving such notice or the defect arises because you failed to follow W H Watts & Son Ltd‘s oral or written instructions or the instructions set out in the manufacturer's product manual as to the construction, storage, use or maintenance of the Products or you alter or repair such Products without the written consent of W H Watts & Son Ltd.

7.5 Subject to condition the Products do not conform with the Warranty W H Watts & Son Ltd and/or the manufacturer of the Products shall at its option repair or replace such Products (or the defective part) or refund the price paid for such Products, provided that you return the Products or the part(s) of such Products which is defective to W H Watts & Son Ltd. Any other refunds or exchanges in respect of unused Products where there is no breach of any Warranty shall be at W H Watts & Son Ltd’s discretion and in any event a refund or exchange will not be considered by W H Watts & Son Ltd more than 30 days of the date of purchase or delivery.

8.0 RETURNS 

8.1 Damaged or missing parts

For all deliveries signed as 'unchecked' any damage and/or missing parts must be reported to us in writing or by e-mail within a resonable period of time (ideally within 24 hours).

If a box looks damaged in any way, shape or form it should be signed for as ‘box damaged’ and any damage/missing parts must be reported to us in writing or by e-mail within a reasonable period of time (ideally within 24 hours).

If a delivery is signed as ‘checked’ any damage/missing parts must be reported to us via e-mail / phone call within 24 hours otherwise any claim will be void for the item and will then become chargeable repair / replacement.

If you used your own courier (not provided by W H Watts & Son Ltd.) then any issues regarding damaged goods must be taken up with them.

If you arranged collection of your goods through your own courier (not provided by W H Watts & Son Ltd.) then any returns will be at your own arrangement and your own cost. W H Watts accepts no responsibility for damaged or missing goods done through an external courier arranged by you (the customer) once the goods leave the store and we do not accept any liability for return costs. This also applies to section 8.2

8.2 - Faulty - Collection will be arranged by us

If you are returning goods deemed to be faulty, no charge will be incurred. Please remember to enclose your name, address, telephone number, email address, order number and reason for returning the goods. If the goods are faulty then a repair, refund or replacement will be offered depending on each individual case. Exceptions to this are if you arranged collection of your goods through your own courier in which case a collection charge may be incurred or you may be required to arrange the return at your own cost.

8.3 Returning Non-Faulty/Non-Damaged Goods 

You must contact us before returning goods as many problems can be solved prior to items being returned. Please Note: All goods collected by our courier will incur a non-refundable minimum return carriage charge of £25.50 per item payable in full prior to arranging  collection of your item(s). Non-mainland UK, Scottish Highland and Island addresses may incur a higher return carriage charge.

If you  return the goods using a different method / courier then you are liable for the cost of returning goods. 

Please remember to enclose your name, address, telephone number, email address, order number and reason for returning the goods.

Items MUST be returned within 7 days of receipt and MUST be complete before a refund can be issued. Returns MUST be sent by recorded delivery .

Postage costs will not be refunded for any returns.

 

9.0 MISCELLANEOUS

9.1 We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.

10.0 DATA PROTECTION / GDRP

10.1 W H Watts & Son Ltd will treat all of your personal information in accordance with all applicable UK data protection laws.

10.2 Your information will enable us to provide you with access to all parts of our site and to supply the goods or services you have requested. It will also enable us to bill you and to contact you where necessary concerning your orders. We will also use and analyse the information we collect so that we can administer, support, improve and develop our business.

 

11.0 CONSUMER PROTECTION (DISTANCE SELLING) REGULATIONS 2000 

11.1 You have the right to cancel any order, but this right ends seven working days after the date of delivery of the Products. W H Watts & Son Ltd will credit you for any cancelled items within 30 days of your cancellation. If W H Watts & Son Ltd has delivered the Products by the date of cancellation you must return the Products to W H Watts & Son Ltd within 14 working days of delivery and pay the costs of doing so. If you fail to return the Products in the specified time, W H Watts & Son Ltd reserve the right to recover the Products from you and you will to pay the costs of W H Watts & Son Ltd doing so.

11.2 Orders may be cancelled by you through written request by letter or e-mail to W H Watts & Son Ltd. Orders will be cancelled upon receipt of written cancellation request prior to product being dispatched. If the order has been dispatched before written cancellation notice has been received by W H Watts & Son Ltd. please refer to section 8.2 returning goods.
